Action by Lester St. Clair against Thomas A. McDonnell (hereinafter the ""defendant"") and American Indemnity Company to recover damages for personal injuries sustained in an automobile accident. The accident occurred December 12, 1963, on a public street in the city of Janesville between an automobile owned and operated by plaintiff which was struck in the rear -- while stopped -- by a car owned and operated by defendant. The case was tried to the court and a jury. The court submitted an ultimate-fact verdict to the jury with respect to the issues of negligence. The jury by its verdict found both defendant and plaintiff causally negligent; apportioned the aggregate negligence 65 percent to defendant and 35 percent to plaintiff; and determined the amount of plaintiff's damages.
